Taxation (International and Other Provisions) Act 2010 section 9

Extended period for submission of full return for period where no restriction

Section 9 provides an extended deadline for submitting a full interest restriction return where a worldwide group has no interest restrictions in the relevant period.

  • This provision applies only where a reporting company has already submitted an interest restriction return for a period of account and no interest restrictions apply to the group in that period.
  • Even if the normal filing deadline has passed, the group can still submit a full interest restriction return within 60 months of the end of the period of account.
  • The standard deadline for submitting a revised return under the normal rules does not prevent a full return from being accepted during this extended window.
  • This extended timeframe gives groups flexibility to upgrade an abbreviated return to a full return where no disallowance applies, without being time-barred by the usual deadline.
