Enforcement of trusts

Paragraph 7 of Schedule 4 gives the Treasury the power to enforce the trusts governing property that is subject to a direction under paragraph 1, and grants the Treasury the same rights as a beneficiary in relation to the management of trustees.

  • Where property is subject to a paragraph 1 direction, the Treasury has the right to enforce the trusts on which that property is held.
  • The Treasury is given the same rights and powers as a beneficiary specifically in relation to trustee management matters.
  • These trustee management powers cover the appointment, removal and retirement of trustees.
  • This provision ensures the Treasury can take action if the trust conditions attached to the tax exemption are not being properly observed.
