Property becoming settled on a death

Section 83 establishes the timing rule for when property is treated as entering a settlement where that settlement arises under a will or on intestacy.

  • This section applies where property becomes part of a settlement as a result of a will or the intestacy rules.
  • The property is treated as having become settled at the date of death of the testator or intestate person.
  • This timing rule applies for the purposes of the settled property charging provisions in Chapter III of Part III of the Act.
  • The rule applies regardless of whether the death occurred before or after the Inheritance Tax Act 1984 was passed.
