Corporation Tax Act 2009 section 57

Regulations under section 81 of FA 2002

Section 57 ensures that the power to make regulations under section 81 of the Finance Act 2002 is preserved, even though the Corporation Tax Act 2009 repeals certain transitional provisions in Schedule 23 to that Act.

  • Schedule 23 to the Finance Act 2002 contained transitional provisions relevant to corporation tax
  • The Corporation Tax Act 2009 repeals some of those transitional provisions as part of the tax law rewrite
  • Section 81 of the Finance Act 2002 grants a power to make regulations in connection with the provisions set out in Schedule 23
  • This paragraph confirms that the regulation-making power under section 81 continues to apply in relation to those repealed provisions, despite their repeal
