Repeals and revocations on 1 April 2009

Schedule 3 Part 1 sets out the extensive list of legislative provisions that were repealed or revoked with effect from 1 April 2009 as a consequence of the Corporation Tax Act 2009 rewriting and consolidating corporation tax law.

  • The Corporation Tax Act 2009 replaced and consolidated numerous existing corporation tax provisions scattered across decades of legislation, from the Taxes Management Act 1970 through to the Finance Act 2008.
  • The repeals cover a very wide range of primary legislation (Acts of Parliament) and secondary legislation (statutory instruments), removing provisions that had been rewritten into the new CTA 2009 in modernised and clearer form.
  • Key Acts affected include the Income and Corporation Taxes Act 1988 (which saw the largest number of repeals), the Finance Act 1996 (including the loan relationships regime in sections 80 to 103 and Schedules 8 to 11), the Finance Act 2002 (including the intangible fixed assets regime in Schedules 12 to 15 and 29, and the research and development provisions), and the Capital Allowances Act 2001.
  • Several statutory instruments were revoked in their entirety, including orders relating to the Finance Act 2002 Schedule 26 amendments, research and development tax relief definitions, investment trust definitions, and authorised investment fund tax regulations.
