General saving for old transitional provisions and savings

Paragraph 8 of Schedule 2 ensures that existing transitional provisions and savings from older legislation are preserved even though the Corporation Tax Act 2009 repeals the original enactments those provisions related to.

  • Old transitional or saving provisions linked to legislation now rewritten in the 2009 Act continue to have effect, provided they were not specifically rewritten themselves
  • Where earlier legislation had already been repealed subject to savings, the 2009 Act's repeal of that legislation does not disturb those existing savings
  • Similarly, if a saving attached to a previous repeal is itself repealed by the 2009 Act, it still operates so far as it remains relevant and has not been specifically rewritten
  • The overall purpose is to prevent the rewrite process from accidentally removing protections or transitional arrangements that taxpayers and practitioners still rely upon
