Deduction for capital expenditure

Section 147 allows cemetery and memorial garden operators to claim a tax deduction for capital expenditure on purchasing and preparing land used for interments or memorial plots.

  • A deduction is available for capital expenditure on purchasing an interest in cemetery or memorial garden land, or on preparing that land, where the land is sold for use for interments or memorial garden plots.
  • Ancillary capital expenditure allocated to the relevant period under section 148 also qualifies for deduction.
  • The same expenditure cannot be claimed more than once under different provisions, including corresponding income tax rules or provisions relating to niches, memorials, or inscriptions.
  • No deduction is given for any purchase price arising from a change in the persons carrying on the trade, or for expenditure that has been met by subsidies.
