Corporation Tax Act 2009 section 236

Payment of tax by instalments

Section 236 allows a company to pay corporation tax on certain lease-related receipts by instalments where the underlying premium or sum is itself payable by instalments.

  • Where a lease premium or certain other lease-related sums (sums payable instead of rent, for surrender of a lease, or for variation or waiver of lease terms) are receivable by instalments, the company may elect to pay the related corporation tax by instalments.
  • The instalments of tax are set at amounts and intervals that an officer of Revenue and Customs may allow.
  • The total period over which the tax instalments are paid must not exceed 8 years.
  • The final instalment of tax must be paid no later than the date on which the last instalment of the premium or sum itself falls due.
