Corporation Tax Act 2009 section 278

Meaning of "rent receivable for a UK electric-line wayleave"

Section 278 defines what counts as rent receivable for a UK electric-line wayleave for corporation tax purposes.

  • Rent qualifies as being for a UK electric-line wayleave if it is received for an easement, servitude, or right in or over land in the United Kingdom that is enjoyed in connection with an electric, telegraph, or telephone wire or cable.
  • The definition extends to rights enjoyed in connection with supporting infrastructure such as poles and pylons, as well as any apparatus used in connection with such wires or cables.
  • The term "rent" is broadly defined to include not only conventional rent but also other receipts in the nature of rent, including those described in section 207(3) relating to income generated from land.
  • The term "wayleave" is used to describe the right over land, replacing the older statutory term "easement", though the definition also encompasses the Scottish legal equivalent, "servitude", ensuring UK-wide coverage.
