Assets representing production expenditure on certain TV programmes

Section 808A excludes certain intangible fixed assets held by television production companies from the intangible fixed assets tax regime in Part 8, where those assets represent production expenditure on a television programme.

  • This section creates a carve-out from the general intangible fixed assets rules in Part 8 of the Corporation Tax Act 2009.
  • The exclusion applies specifically to television production companies as defined for tax purposes.
  • The intangible fixed asset in question must represent a television programme production budget falling within the special TV production company tax rules in Chapter 2 of Part 15A.
  • Where the exclusion applies, the asset is instead dealt with under the dedicated television production company tax regime rather than the general intangible assets rules.
