Overview of Chapter

Section 880 provides a roadmap to Chapter 16, which governs the transitional rules determining which intangible fixed assets fall within the Part 8 regime and which remain subject to the older tax rules.

  • Part 8 generally only applies to intangible fixed assets created or acquired on or after 1 April 2002; assets held before that date remain under the previous tax regime.
  • The Chapter sets out detailed rules for determining when an asset is treated as having been created or acquired, which is critical in deciding whether Part 8 applies.
  • Special provisions deal with particular categories of assets, such as fungible assets and telecommunication rights.
  • Roll-over relief rules address situations where a disposal or degrouping charge involves assets that are excluded from Part 8 by the general 1 April 2002 cut-off date.
