Power to deal with other special cases

Section 585 provides a general power for HM Treasury to make regulations modifying the rules about manufactured payments to deal with special cases not specifically covered elsewhere.

  • HM Treasury has a broad regulation-making power to modify the manufactured payments rules in sections 572 to 582 and Chapter 9 of Part 15 of the Income Tax Act 2007.
  • This power allows the Treasury to address special or unusual situations that arise in practice but are not dealt with by the specific manufactured payments provisions.
  • Regulations made under this section can adapt the tax treatment of manufactured dividends, manufactured interest, and other manufactured payments to fit circumstances that the main legislation does not fully cover.
  • The provision originates from paragraph 8(1) of Schedule 23A to the Income and Corporation Taxes Act 1988, carried forward into the 2007 consolidation.
