Partial exemption where later associated operations fail conditions

Section 742 restricts the amount of income on which an individual can be taxed under the transfer of assets abroad rules, where certain later associated operations do not meet the required conditions for full exemption.

  • Where this section applies, the individual is only taxed on part of the income, not the full amount that would otherwise be chargeable
  • An HMRC officer determines the taxable portion based on what is justly and reasonably attributable to the relevant operations, considering all the circumstances of the case
  • The circumstances taken into account include how far the operations directly or indirectly affect the nature or amount of any person's income
  • The circumstances also include how far the operations directly or indirectly affect any person's power to enjoy income
