Effect on what is chargeable

Section 809F explains how foreign earnings, foreign income, and foreign chargeable gains are taxed when the remittance basis applies to an individual for a tax year.

  • Where the remittance basis applies, foreign earnings, foreign income, and foreign chargeable gains are each taxed only when remitted to the UK, under their respective charging rules
  • Special rules apply to amounts counting as employment income from employment-related securities and from income provided through third parties
  • An individual who is UK domiciled but not ordinarily UK resident and who claims the remittance basis is still taxed on the arising basis for chargeable gains
  • These remittance basis charging rules do not apply to any income or gains that the individual has nominated for the purposes of the Remittance Basis Charge
