Oil Taxation Act 1983 Schedule 2 paragraph 7

Insurance or compensation payments for lost or destroyed qualifying assets

Paragraph 7 of Schedule 2 requires that any insurance or compensation payment received for the loss or destruction of a qualifying asset must be treated as a disposal receipt for oil taxation purposes.

  • Where a qualifying asset is lost or destroyed and an insurance or compensation payment is received, that payment must be brought into account as a disposal receipt.
  • The payment is treated as consideration received for a disposal of the asset, even though no actual sale or transfer has taken place.
  • The deemed disposal is treated as occurring at the time the insurance or compensation payment is received or becomes receivable.
  • This ensures that insurance and compensation proceeds relating to qualifying assets are subject to the same disposal receipt rules as proceeds from actual asset disposals.
