Regulations and orders

Section 17 explains how the government makes regulations and orders under the Small Charitable Donations Act, including the parliamentary approval process and the flexibility allowed in drafting them.

  • All regulations and orders under the Act must be made by statutory instrument, the standard formal method for secondary legislation.
  • Before any such statutory instrument can be made, a draft must be laid before and approved by a resolution of the House of Commons (the affirmative procedure).
  • Regulations and orders may apply generally or only in specified cases or circumstances, and may make different provision for different situations.
  • They may also include consequential, supplementary, incidental, transitional or saving provisions as needed.
