Time limit: interest restriction return following determination under paragraph 56

Section 57 provides an extended time limit for submitting or revising an interest restriction return after HMRC has issued a determination under paragraph 56.

  • When HMRC issues a determination and no interest restriction return has yet been filed, the group has 12 months from the date of the determination notice to submit one, even if the normal filing deadline has passed.
  • When HMRC issues a determination and an interest restriction return has already been filed, the group has 12 months from the date of the determination notice to submit a revised return, even if the normal revision deadline has passed.
  • In both cases, the 12-month extension runs from the date on which the notice of determination is given to the company.
  • The "relevant period of account" is the period of account to which HMRC's determination relates.
