Orders and regulations

Section 499 explains how the Treasury and HMRC make orders and regulations under this Act, and the Parliamentary procedures that apply to them.

  • All orders and regulations under this Act must be made by statutory instrument.
  • Statutory instruments are generally subject to the negative procedure, meaning the House of Commons can annul them by resolution.
  • Certain regulations are exempt from the negative procedure, including those relating to double taxation relief, specific offshore fund provisions subject to the affirmative procedure, and transitional orders.
  • An older provision in the Income and Corporation Taxes Act 1988 regarding pre-April 2010 orders does not apply to orders made by the Treasury under this Act before that date.
