Meaning of "relevant public body"

Section 491 defines what counts as a "relevant public body" for the purposes of the corporate interest restriction rules.

  • A relevant public body includes the Crown, government departments (including Northern Ireland departments), Ministers of the Crown, foreign sovereign powers, and local authorities or local authority associations.
  • It also covers designated educational establishments, health service bodies, and any other body that operates under legislation for public purposes and not for its own profit.
  • Any wholly-owned subsidiary of a body falling within the definition is itself treated as a relevant public body.
  • HMRC may amend the definition by regulations, but cannot extend it to include any person who has no functions of a public nature.
