Assessments where section 946 payment included in return

Section 956 allows HMRC to make a tax assessment on a person who has made a deposit-taker or building society payment (a "section 946 payment") where the income tax due on that payment has not been paid by the required deadline.

  • Where income tax on a section 946 payment included in a return has not been paid by the deadline set out in section 951, HMRC may take action
  • An officer of Revenue and Customs may raise a formal tax assessment on the person who made the payment
  • The assessment can be raised regardless of whether the tax has actually been paid by the time the assessment is made
  • This provision ensures HMRC has a mechanism to pursue unpaid tax even after late payment has occurred
