Income Tax Act 2007 section 957

Assessments in other cases

Section 957 deals with the power of HMRC officers to make assessments where returns of deposit interest payments are incomplete or incorrect.

  • HMRC may act where a section 946 payment (a deposit interest payment) has been omitted from a return that should have included it
  • HMRC may also act where a return submitted under this chapter is otherwise incorrect
  • An HMRC officer may raise an assessment based on their best judgement against the person who made the return
  • The assessment power also extends to a person who should have made a return but failed to do so
