General deduction rules

Section 159 confirms that the codification of specific deduction rules for certain types of miscellaneous income does not displace similar established legal principles that apply when calculating other income under the Act.

  • The deduction rules set out for intellectual property income (such as royalties) do not override similar principles used elsewhere in the Act
  • The calculation rules for non-trading income from films, sound recordings, and telecommunication rights likewise do not displace equivalent rules applying to other income
  • Existing legal principles for calculating deductions continue to operate in relation to all other types of income and profits chargeable under the Act
  • The purpose is to preserve the general body of law on deductions, ensuring that codifying specific rules in one area does not create a negative inference that similar rules cannot apply elsewhere
