Oil extraction and related activities

Section 16 requires oil-related activities carried on as part of a trade to be treated as a separate trade for income tax purposes, ring-fencing them from the person's other trading activities.

  • Any oil-related activities carried on as part of a trade must be treated as a separate, distinct trade for income tax purposes
  • Oil-related activities include oil extraction activities and the acquisition, enjoyment or exploitation of oil rights
  • The practical effect of this ring-fence is that losses from other trading activities cannot be set against oil profits
  • The provision covers oil and gas exploration and extraction in the United Kingdom and the UK sector of the continental shelf
