Requirements relating to options: introduction

Section 34 introduces the four key requirements that a share option must satisfy at the appropriate time in order to qualify as a qualifying option under this part of the Schedule.

  • The type of shares that may be acquired under the option must meet specific criteria set out in paragraph 35.
  • There are rules governing when the option is capable of being exercised, as detailed in paragraph 36.
  • The terms of the option must be agreed in writing between the parties, as required by paragraph 37.
  • The rights under the option cannot be transferred or assigned to another person, as set out in paragraph 38.
