Acts of Parliament — repeals

Schedule 8 Part 1 lists the specific provisions in Acts of Parliament that are repealed as a consequence of the enactment of ITEPA 2003, which consolidated and replaced earlier employment income tax legislation.

  • ITEPA 2003 replaced a wide range of employment tax provisions previously scattered across numerous Acts of Parliament dating from 1970 to 2002, and Schedule 8 Part 1 formally repeals those superseded provisions.
  • Major repeals affect the Income and Corporation Taxes Act 1988 (including the old Schedule E charging rules, benefits-in-kind provisions, PAYE regulations, share scheme rules, and pension scheme taxation provisions) and successive Finance Acts that amended them.
  • Consequential repeals also extend to social security legislation, the Taxation of Chargeable Gains Act 1992, the Capital Allowances Act 2001, and various other Acts that contained cross-references to the old employment income tax rules.
  • Certain provisions are only partially repealed — for example, parts of ICTA 1988 section 187 are retained so far as they relate to profit sharing schemes, and ICTA 1988 Schedule 9 Parts 1, 2 and 6 are repealed only to the extent they do not relate to profit sharing schemes.
