Section 61B: supplementary

Section 61C provides supplementary definitions and powers relating to the meaning of a managed service company under section 61B, including the Treasury's power to exclude certain persons and definitions of key terms.

  • The Treasury may issue orders excluding prescribed persons from being treated as "involved with the company" under section 61B, and such orders can apply for the entire tax year in which they are made.
  • For managed service company purposes, "company" means either a body corporate or a partnership.
  • An associate of a person includes anyone who acts in concert with that person to ensure an individual's services are provided through a company.
  • An "undertaking to make good any tax loss" is broadly defined to cover any commitment to compensate an individual or their associate for costs arising from tax legislation, national insurance legislation, or related subordinate legislation applying to their payments.
