Schedule 10A, paragraph 11 – Evidence requirements for sub-sale development relief claims

Section 11 of Schedule 10A requires that when a first buyer claims sub-sale development relief, their LBTT return must include evidence specified by Revenue Scotland showing that significant commercial development of the property will be completed within the required timeframe.

  • When claiming sub-sale development relief, the first buyer must submit supporting evidence alongside their LBTT return.
  • The evidence must relate to the significant development for commercial purposes that is planned for the property involved in the qualifying sub-sale.
  • Revenue Scotland has the power to specify what form this evidence must take.
  • The evidence must demonstrate that the significant commercial development will be completed within the relevant period allowed under the relief rules.
