Meaning of first-time buyer

Schedule 4A paragraph 2 defines who qualifies as a "first-time buyer" for the purposes of first-time buyer relief from Land and Buildings Transaction Tax.

  • A first-time buyer is someone who has never previously purchased a major interest in residential property containing a dwelling in Scotland.
  • The person must also never have acquired an equivalent interest in a dwelling situated anywhere outside Scotland.
  • Both conditions must be met — any prior ownership of a dwelling, whether in Scotland or elsewhere, disqualifies the buyer.
  • The definition applies throughout Schedule 4A, which governs first-time buyer relief from LBTT.
