Power to modify exempt transactions

Schedule 1, paragraph 8 gives the Scottish Ministers the power to change the list of exempt land transactions by making regulations.

• Scottish Ministers can add new types of land transaction to the list of exempt transactions
• They can also remove existing exemptions, so that a type of transaction previously exempt becomes taxable
• They can vary or adjust the description of an existing exempt transaction without fully adding or removing it
• All such changes must be made by way of regulations, providing a formal legal mechanism for updating the exemptions
