Land and Buildings Transaction Tax (Scotland) Act 2013 section Sch 4 para 24

Connected companies

Schedule 4 paragraph 24 extends references to a company throughout Schedule 4 to include any company connected with that company.

  • Where Schedule 4 refers to a company, the reference is not limited to that specific company alone
  • Any company that is connected with the company in question is also caught by the same provisions
  • This prevents arrangements where obligations or rules could be avoided by using a connected company instead of the principal company
  • The concept of connected companies is a well-established principle in tax law, typically covering relationships such as common control or group membership
