Interest on unpaid tax

Section 217 establishes that interest is charged on tax that remains unpaid after its due date, and sets out how that interest is calculated.

  • Interest accrues on any unpaid tax from the date payment was due until the date it is actually paid.
  • The due date for payment (called the "relevant date") is set by the Scottish Ministers through regulations.
  • If a taxpayer has lodged an amount with Revenue Scotland towards the tax due on a transaction, interest is only charged on the remaining balance.
  • The rate at which interest is calculated is determined under separate provisions (section 220 of the Act).
