VAT evasion: liability of directors etc.

Section 61 formerly dealt with the personal liability of company directors and other officers for penalties arising from VAT evasion by the company, but has been repealed.

  • Section 61 originally imposed personal liability on directors and other company officers where VAT evasion had occurred
  • The section was omitted from the Value Added Tax Act 1994 by the Finance Act 2007, section 97 and Schedule 24, paragraph 29(d)
  • It was formally repealed by the Finance Act 2007, section 114 and Schedule 27, Part 5(5), with effect from the various dates appointed under Finance Act 2007, section 97
  • The provisions relating to penalties for evasion and the personal liability of company officers are now found within the broader penalty regime introduced by the Finance Act 2007
