Preservation of information etc.

Schedule 4, paragraph 2 amends the existing rules on preserving information and records (found in section 39 of the Tax Collection and Management (Wales) Act 2016) to ensure that specific record-keeping requirements under the Landfill Disposals Tax take priority where applicable.

• The original text of section 39 (preservation of information etc.) is renumbered as subsection (1).
• A new subsection (2) is added, which creates exceptions to the general record-keeping rules.
• The exceptions relate to water discount records required under section 21(7) of the Landfill Disposals Tax (Wales) Act 2017 and landfill disposals tax summary records required under section 43(2) of the same Act.
• Where those specific landfill disposals tax provisions impose their own record-keeping requirements, those requirements override the general preservation of information rules.
