Relevant transactions for multiple dwellings relief

Schedule 13 paragraph 3 defines which transactions qualify as "relevant transactions" eligible for multiple dwellings relief, and which transactions are excluded from the relief.

  • A relevant transaction is a chargeable transaction involving interests in two or more dwellings, either in a single transaction or through linked transactions, provided it is not excluded by specific reliefs.
  • Transactions are excluded from multiple dwellings relief where relief for collective rights, group relief, reconstruction and acquisition relief, or charities relief is available, even if that relief is later withdrawn.
  • An interest in a dwelling means any chargeable interest in or over a dwelling, but where a dwelling is subject to a lease of more than 21 years, any superior interest above that lease is generally not treated as an interest in a dwelling for the purposes of calculating the relief.
  • The exception for long leases does not apply in certain sale and leaseback arrangements where the seller is a qualifying body, the transaction involves granting a leasehold interest, and the leaseback element qualifies for sale and leaseback relief.
