Land Transaction Tax and Anti-avoidance of Devolved Taxes (Wales) Act 2017 section 9

Land partly in Wales and partly in England

Section 9 deals with how land transaction tax applies when a single transaction involves land that straddles the border between Wales and England.

  • A cross-border land transaction must be split into two notional transactions: one for the Welsh land and one for the English land.
  • The total consideration (purchase price or other payment) must be apportioned between the two parts on a just and reasonable basis.
  • The Welsh portion is subject to land transaction tax under this Act, while the English portion falls under stamp duty land tax under the Finance Act 2003.
  • The Welsh Revenue Authority (WRA) must publish guidance on cross-border transactions, including how to identify the precise location of the Wales–England border.
