The consideration attributable to dwellings

Schedule 13 paragraph 4 explains how the total chargeable consideration in a land transaction is split between the dwelling element and the non-dwelling element, and defines single dwelling and multiple dwelling transactions.

  • For a single dwelling transaction, the consideration attributable to dwellings is the portion of the total chargeable consideration that relates to that one dwelling; for a multiple dwelling transaction, it is the portion that relates to all the dwellings combined.
  • The remaining consideration is whatever is left after deducting the dwelling element from the total chargeable consideration — this covers any non-residential property included in the same transaction.
  • A transaction is a single dwelling transaction if its main subject matter is an interest in one dwelling (whether or not other non-dwelling property is also included), and a multiple dwelling transaction if it involves interests in two or more dwellings (again, with or without other property).
  • Any apportionment of consideration between dwellings and other property must be made on a just and reasonable basis.
