Joint buyers: general rules

Section 37 sets out the general rules that apply when two or more buyers are jointly acquiring an interest in land for the purposes of Land Transaction Tax.

  • Where two or more buyers jointly acquire an interest in land, their obligations under the Act are joint obligations, though any one buyer can fulfil them on behalf of all.
  • Anything required or authorised to be done by or in relation to the buyer must be done by or in relation to all of the joint buyers together.
  • Any liability arising under the Act, including penalties for failing to meet obligations, is a joint and several liability — meaning the Welsh Revenue Authority can pursue any one buyer for the full amount owed.
  • These general rules are subject to specific provisions dealing with returns, declarations, appeals, and reviews, as well as separate rules for partnerships and trustees.
