Definition of qualifying land

Schedule 21A paragraph 3 defines the conditions that must be met for land involved in a transaction to be classified as "qualifying land" for the purposes of special tax site relief.

  • Land must meet two conditions on the effective date of the transaction to be considered qualifying land.
  • The first condition is that the land must be situated within a designated special tax site.
  • The second condition is that the buyer must intend to use the land exclusively in a qualifying manner.
  • Both conditions must be satisfied simultaneously — location within a special tax site alone is not sufficient.
