Schedule 7 paragraph 52: definition of "arrangements"

Paragraph 52 of Schedule 7 defines the term "arrangements" as used throughout the Schedule, by referring back to the definition in section 31(3) of the Act.

  • The term "arrangements" is used in several anti-avoidance provisions within Schedule 7.
  • Rather than providing its own definition, paragraph 52 adopts the meaning set out in section 31(3) of the Act.
  • Under section 31(3), "arrangements" is defined broadly and includes any agreement, understanding, scheme, transaction, or series of transactions, whether or not legally enforceable.
  • This wide definition ensures that informal or non-binding plans intended to circumvent the reliefs rules are caught, not just formal contractual arrangements.
