"Company"

Section 1121 defines what the term "company" means for the purposes of the Corporation Tax Acts, setting out which types of entity are included and which are specifically excluded.

  • A "company" means any body corporate or unincorporated association for corporation tax purposes.
  • Partnerships, co-ownership schemes, local authorities, and local authority associations are all excluded from the definition.
  • The trustees of an authorised unit trust are treated as a UK resident company for certain corporation tax purposes, effectively bringing them within the definition.
  • Co-ownership schemes are those defined under section 235A of the Financial Services and Markets Act 2000, which relates to certain collective investment arrangements.
