Delegation of powers to the Regulator of Social Housing

Section 646 allows the Secretary of State to delegate their approval and oversight functions for co-operative housing associations to the Regulator of Social Housing.

  • The Secretary of State may delegate functions relating to the approval of housing associations and the tests they must satisfy to the Regulator of Social Housing.
  • Delegation only applies to housing associations that are registered providers of social housing under the Housing and Regeneration Act 2008.
  • The Secretary of State controls the scope of any delegation and may limit it to whatever extent they choose.
  • The Secretary of State may attach specific conditions to any delegated functions.
