Cases where consideration receivable by person not assessed

Section 829, which dealt with situations where the consideration receivable in certain transactions was received by a person other than the one being assessed to tax, was part of a wider set of provisions that have been entirely removed from the legislation.

  • Section 829 was part of Part 18 of the Corporation Tax Act 2010, which addressed cases where consideration receivable arose in the hands of a person who was not the one assessed to corporation tax.
  • The entire Part 18, including section 829, was repealed by the Finance Act 2016, section 77(4).
  • The repeal took effect for disposals made on or after 5 July 2016, meaning the provisions still applied to any disposals that occurred before that date.
  • Accountants dealing with corporation tax matters for disposals from 5 July 2016 onwards no longer need to consider section 829 or the rest of Part 18, as these provisions are no longer part of the active legislation.
