Corporation Tax Act 2010 section 210

Market value of qualifying investments

Section 210 sets out how the market value of qualifying investments is to be determined for the purposes of the relief for gifts of shares, securities and real property to charities.

  • Market value of qualifying investments is determined using the standard capital gains tax valuation rules in sections 272 to 274 of TCGA 1992.
  • A special rule applies to interests in offshore funds where the fund managers regularly publish separate buying and selling prices.
  • For such offshore fund interests, market value is taken as the buying price (the lower price) published on the day of disposal, or the latest day before that on which prices were published.
  • The term "offshore fund" takes its meaning from section 355 of TIOPA 2010.
