Certificate required from charity

Section 213 requires that when a company disposes of a qualifying interest in land to a charity and wishes to claim tax relief, it must first obtain a certificate from the charity confirming the transaction.

  • This section applies only where the qualifying investment is a qualifying interest in land
  • A company cannot claim charitable donations relief unless it holds a certificate from the charity (or someone authorised on the charity's behalf)
  • The certificate must describe the land interest, state the date of disposal, and confirm the charity has acquired it
  • This is the first of four sections dealing specifically with qualifying interests in land
