Interpretation of Chapter

Section 560 establishes how the provisions of Chapter 7 (dealing with gains in the context of Real Estate Investment Trusts) should be interpreted, by linking them to the capital gains tax legislation.

  • Chapter 7 deals with capital gains matters relating to UK REITs
  • The chapter (apart from section 559 on demergers) must be read as if it formed part of the Taxation of Chargeable Gains Act 1992 (TCGA 1992)
  • This means that all the defined terms, rules, and interpretive principles of TCGA 1992 apply when reading this chapter
  • Section 559, which concerns demergers and companies leaving a group UK REIT, is excluded from this interpretive rule and stands on its own terms
