Land outside the UK

Section 848 explains how references to interests in land and their disposal should be interpreted when the land in question is located outside the United Kingdom.

  • This section applies to land situated outside the United Kingdom.
  • References in this chapter to interests in land should be read as referring to the corresponding interests that exist under the relevant foreign legal system.
  • References to dispositions of interests in land should similarly be read as referring to the equivalent dispositions recognised under foreign law.
  • The purpose is to ensure the rules in this chapter can operate effectively regardless of whether the land is in the UK or overseas.
