Payment of income tax and capital gains tax: simple assessments

Section 59BA sets out when and how much tax is payable by a person who has been issued with a simple assessment for a tax year, after taking account of payments already made and tax deducted at source.

  • The amount payable under a simple assessment is the difference between the total income tax and capital gains tax shown in the assessment and the total of any payments on account already made plus any income tax deducted at source for that year.
  • If notice of the simple assessment is given after 31 October following the tax year, the balance is due three months after the date the notice was given; otherwise it is due by 31 January after the end of the tax year.
  • No repayment of income tax is required where the Income Tax Acts provide that the tax in question is not repayable.
  • PAYE regulations may prescribe adjustments to the amount of tax treated as deducted at source under PAYE when calculating the balance payable.
