Special jurisdiction relating to Business Expansion Scheme

Section 47B establishes which specialist tribunals have jurisdiction to determine land valuation disputes arising from appeals connected with the Business Expansion Scheme.

  • Where an appeal against refusal or withdrawal of Business Expansion Scheme relief involves a dispute over the value of an interest in land, the matter must be referred to a specialist land valuation tribunal.
  • For land in England and Wales, the dispute is referred to the Upper Tribunal.
  • For land in Scotland, the dispute is referred to the Lands Tribunal for Scotland.
  • For land in Northern Ireland, the dispute is referred to the Lands Tribunal for Northern Ireland.
