Gains from branch or agency

Section 84 dealt with the assessment and collection of tax on capital gains arising to non-residents through a branch or agency in the United Kingdom, but has been repealed.

  • Section 84 originally provided rules for taxing capital gains that non-UK residents made through a UK branch or agency.
  • The section ensured that where a non-resident carried on trade or other activities in the UK via a branch or agency, any chargeable gains connected with that presence could be assessed to tax.
  • This provision was repealed by the Finance Act 1995, Schedule 29, Part 8(16), meaning it no longer has effect.
  • The taxation of non-residents' gains connected with UK activities is now governed by other provisions introduced subsequently.
