The relevant percentage

Section 329E defined the relevant percentage used in calculations under the profits from intellectual property regime, but this section has been repealed.

  • Section 329E was part of Chapter 5A (sections 329A–329T) of the Corporation Tax Act 2010, which dealt with profits arising from the exploitation of patents and other intellectual property.
  • The entire Chapter 5A, including section 329E, was repealed by the Finance Act 2015 (Schedule 11, paragraph 13(1)).
  • The repeal takes effect in relation to accounting periods ending on or after 5 December 2013, meaning the provisions have no application for any such periods.
  • Any company that previously relied on Chapter 5A for its corporation tax treatment of intellectual property profits should ensure its calculations for affected periods reflect the removal of these provisions.
